These Terms and Conditions govern access to and use of the Net-HealthData website, clinician portal, patient mobile application and associated remote monitoring services (together, the "Service"). By creating an account, accessing or using the Service, you agree to these Terms.
The Service is provided by Net-Health Pty Ltd ("Net-Health", "Net-HealthData", "we", "us" or "our"). These Terms should be read together with our Privacy Policy and any applicable hospital, health service or healthcare provider consent documentation.
Net-HealthData supports remote monitoring, communication and clinical workflows by enabling health information, including readings from compatible devices and information entered by users, to be made available to authorised healthcare professionals.
The Service does not replace appropriate face-to-face assessment, emergency care or other clinical care. Your treating healthcare professional remains responsible for clinical decisions and advice within the scope of their professional relationship with you. Net-Health does not independently diagnose, prescribe or provide medical advice unless expressly stated as part of a separately authorised clinical service.
You must seek prompt medical advice if your condition changes or symptoms worsen. Do not rely on the Service, alerts, messages or device readings for emergency or time-critical care.
You must provide accurate information when registering and keep your account information reasonably up to date. Access is limited to authorised users.
You are responsible for protecting your login credentials and for taking reasonable precautions to prevent unauthorised access to your account. You must not share credentials, attempt to access another person's account, circumvent security controls, introduce malicious code, or use the Service outside the access permissions granted to you.
Where supported or required by the relevant health service, additional authentication or identity controls may be applied. Net-Health may suspend or restrict access where reasonably necessary to protect patients, users, information, systems, intellectual property or the security and integrity of the Service.
The Service may collect personal information and sensitive information, including health information, that you or your healthcare provider enter into the Service, information received from connected medical devices or third-party systems, and technical information required to operate, secure and support the Service.
Net-Health handles personal information in accordance with applicable Australian privacy law, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply, and any other applicable State or Territory health privacy requirements.
Personal and health information is used or disclosed only for purposes connected with providing, administering, securing and supporting the Service; enabling authorised clinical care and monitoring; complying with legal or regulatory obligations; or as otherwise authorised or consented to by the individual.
Net-Health takes reasonable technical and organisational steps to protect personal and health information from misuse, interference, loss, unauthorised access, modification and disclosure. Security controls are applied having regard to the sensitivity of health information, the nature of the Service, applicable contractual requirements and contemporary cyber security practices.
These controls may include, as appropriate to the relevant environment:
No internet-connected system can be guaranteed to be completely secure. However, Net-Health does not treat transmission of health information as being solely at the user's risk and maintains security safeguards appropriate to the information and Service.
Net-HealthData user information is hosted on cloud infrastructure located in Australia and is backed up in Australia, subject to the architecture and contractual arrangements applicable to the Service.
Net-Health may use vetted technology, cloud, communications, support or integration providers to operate the Service. Where a provider processes personal information on our behalf, Net-Health applies appropriate contractual, privacy and security requirements and limits access to what is reasonably necessary for the provider's function.
If an arrangement would involve disclosure of personal information outside Australia, it will be managed in accordance with applicable privacy law and contractual requirements.
Personal and health information is retained only for as long as required for the purposes for which it is held, to meet applicable legal, clinical-record, contractual, regulatory, audit or health-service retention requirements, or as otherwise permitted by law.
Retention periods may differ depending on the health service, the type of record and the applicable jurisdiction. Where Net-Health acts on behalf of a hospital or health service, retention and disposal may be governed by that organisation's approved retention requirements and instructions.
When personal information is no longer required and there is no legal or contractual requirement to retain it, Net-Health will take reasonable steps to securely destroy or de-identify it. Backup copies may remain for a limited period until they are overwritten or securely removed in accordance with backup and retention processes.
Net-Health maintains processes to identify, contain, assess, investigate and respond to suspected or actual security incidents involving personal information.
Where a data breach is likely to result in serious harm and the Notifiable Data Breaches scheme applies, Net-Health will take the steps required by the Privacy Act 1988 (Cth), including notification to affected individuals and the Office of the Australian Information Commissioner where required. Net-Health will also comply with applicable contractual and health-service incident notification obligations.
The Service may receive information from compatible medical devices, applications or third-party systems. Device readings and third-party data may be affected by device accuracy, connectivity, user technique, configuration, transmission delays or third-party service availability.
Net-Health will take reasonable steps to preserve the integrity of information received by the Service but does not manufacture or control third-party devices or services. Users should follow device instructions and promptly raise suspected inaccurate or missing readings with their healthcare provider where clinically relevant.
Net-Health takes reasonable steps to maintain the availability and operation of the Service. Access may occasionally be interrupted for planned maintenance, upgrades, security activities, telecommunications failures, third-party outages or events outside Net-Health's reasonable control.
Where practicable, planned interruptions will be managed to minimise disruption. The Service must not be used as the sole means of communication for urgent or emergency clinical matters.
The Service may contain links to third-party websites, resources or services. Unless expressly stated, Net-Health does not control or endorse third-party content and is not responsible for the privacy, security, accuracy or availability of third-party sites or services. Use of third-party services is subject to their own terms and privacy practices.
Copyright and other intellectual property rights in the Service, including software, interfaces, text, graphics, documentation and other content owned by Net-Health, are protected by Australian and international intellectual property laws. Except as permitted by law or expressly authorised, you must not copy, reproduce, modify, reverse engineer, distribute or commercially exploit the Service or its content.
Net-Health may limit, suspend or terminate access where reasonably necessary because of a breach of these Terms, suspected unauthorised access, security risk, misuse, legal or regulatory requirement, termination of the relevant health-service arrangement, or protection of patients, users, systems or intellectual property.
Termination of access does not automatically mean that health information will be immediately deleted. Information will be retained, returned, transferred, de-identified or securely destroyed in accordance with applicable law, contractual obligations, health-service instructions and the retention requirements described in these Terms.
To the maximum extent permitted by law, Net-Health is not liable for loss caused by matters outside its reasonable control, including failures of third-party networks, devices or services, or by a user's unauthorised or improper use of the Service.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. Any exclusion or limitation of liability in these Terms operates only to the extent permitted by law.
Net-Health may update these Terms to reflect changes to the Service, security practices, technology, law or regulatory requirements. Where a change is material, reasonable steps will be taken to notify affected users or make the updated Terms available through the Service. Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
Questions about privacy, access to or correction of personal information, account deletion, or concerns about the security of information should be directed to Net-Health through the contact details published in the Service or on the Net-Health website. Requests may need to be coordinated with the relevant hospital or health service where that organisation is responsible for the clinical record or determines how the information is handled.
These Terms are governed by the laws applicable in Queensland, Australia, unless another jurisdiction is required by law or by the contractual arrangements under which the Service is provided.
